Asked for its opinion on the interpretation of regulatory texts, the Council of State reiterated that the regulation of subcontracting falls, in accordance with the current legal framework, under the jurisdiction of the Ministry of SMEs, exercised through the Regulatory Authority for Subcontracting in the Private Sector (ARSP).

In the interest of ensuring consistency in government action, the high court recommends better harmonization of interventions by the various ministries involved, in order to preserve the clarity of institutional responsibilities and the effectiveness of public policies.

This clarification reinforces the government's efforts to structure national subcontracting and foster the emergence of a strong middle class, in line with the vision of Head of State Félix Antoine Tshisekedi.

Immediate cancellation of irregular contracts at Kibali Gold Mine

The Regulatory Authority for Subcontracting in the Private Sector (ARSP) has ordered the immediate cancellation of contracts deemed irregular concluded between Kibali Gold Mine and the companies KMS, Boart Longyear as well as the TAI Services purchasing center.

This decision follows the finding of the ineligibility of these companies to carry out subcontracting activities in the private sector, in accordance with the regulations in force.

The Services and Logistics company (SSL), operating within the mining company METALKOL, a subsidiary of the ERG Group, specializes in personnel transportation and the supply of spare parts.

Previously hampered within METALKOL by companies ineligible for subcontracting, SSL congratulates ARSP CEO Miguel KASHAL KATEMB for enabling companies with majority Congolese capital to realize the vision of Head of State Félix Tshisekedi by creating jobs.

To date, SSL has a staff of 140 employees, with large buses providing transportation for METALKOL employees and other partners working on the mining company's site located in Kolwezi in Lualaba province.

European Parliament: ARSP Director General Miguel Kashal Katemb received at the Development Commission for discussions on the development of the value chain in the DRC.

During his working visit to Brussels in Belgium, the CEO of the ARSP was received at the headquarters of the European Parliament by the Euro-Luxembourg MP Charles Goerens, member of the Development Committee, former Luxembourg Minister of Defense and Environment and the economy.
